U.S. Department of State Updates Position on ART and Automatic Citizenship Transmission Upon Birth Abroad

The DOS’ new policy states that a U.S. citizen mother may transmit U.S. citizenship to a child conceived through Assisted Reproductive Technology (ART) if she is the legal mother at the time and place of the child’s birth and the child is biologically connected to her by either genetics or gestation.
